Terms of Enrollment

These Terms of Enrollment and Program Participation govern participation in The Superhero Job Search Method™ program offered by ElevateExecs.

These Terms of Enrollment and Program Participation ("Terms") govern participation in The Superhero Job Search Method™ ("Program") offered by ElevateExecs ("ElevateExecs," "we," "us," or "our"). By enrolling in, accessing, or participating in the Program, you ("Participant" or "you") acknowledge that you have read, understood, and agreed to these Terms.

1. Program Format and Access

The Superhero Job Search Method is a group-based executive job search coaching and implementation program. It is not a one-on-one coaching program, and enrollment does not include regularly scheduled private coaching calls with Kent Lee.

The initial Program support period is twelve weeks. During that period, participants receive access to three group coaching calls per week, subject to reasonable scheduling changes, holidays, and availability. Recordings of group calls may be made available to participants.

Access to live coaching, feedback, reviews, and other active Program support ends at the conclusion of the twelve-week support period unless Participant qualifies for an extension under the 90-Day Success Guarantee below.

Participant receives ongoing access to the Program course materials after the support period. ElevateExecs may update, replace, reorganize, migrate, or discontinue particular platforms or materials when reasonably necessary.

2. Participant Responsibilities

The Program provides education, strategy, coaching, templates, messaging, feedback, and implementation support. Participant remains solely responsible for completing the work, implementing the strategies, making job search decisions, communicating with employers and networking contacts, and determining whether an opportunity is appropriate.

Participant agrees to provide accurate information, complete Program assignments in good faith, track required job search activity, and request assistance when clarification or support is needed.

3. Payment and Financing

Payment of the enrollment fee is due in full at the time of purchase unless Participant enrolls through an approved third-party financing or installment provider, such as Klarna or ClarityPay.

Where Participant elects a financing or installment option, the arrangement is between Participant and the third-party provider and is governed by that provider's own terms, rates, and conditions. ElevateExecs is not a lender and is not a party to that financing arrangement. Any dispute, delay, decline, or issue with a financing provider does not suspend these Terms, delay or reduce Participant's obligations under these Terms, or create any right to a refund, credit, or extension of the Program.

Participant is responsible for completing any financing application accurately and for meeting the financing provider's repayment obligations.

4. 90-Day Success Guarantee

The Success Guarantee ends only when Participant accepts a Qualifying Full-Time Offer or the maximum additional support period expires, whichever occurs first.

A "Qualifying Full-Time Offer" means a full-time role at the level and compensation Participant is targeting, which Participant has accepted. An offer only counts under the Success Guarantee when Participant accepts it. Declining an unsuitable offer does not affect eligibility.

Consulting, contract, part-time, short-term, lower-level, or below-target work does not end the Success Guarantee. Interim or nonqualifying work does not end the Success Guarantee, but it does not excuse continued participation in the Program or completion of required activities.

The Success Guarantee provides additional support only. It is not a money-back guarantee and does not entitle Participant to a refund, reimbursement, credit, or other payment.

Eligibility Requirements

  • Applied to at least five appropriate jobs per week using a resume tailored according to the Program methodology for at least nine of the twelve Program weeks.
  • Maintained a complete application tracker identifying each position, employer, application date, and link to the applicable job posting.
  • Retained and submitted, upon request, each tailored resume and the corresponding job-posting link.
  • Completed and submitted the required Program worksheets, messaging exercises, trackers, and implementation materials.
  • Sent at least twenty targeted LinkedIn connection requests per day, five days per week, in accordance with the Program targeting strategy.
  • Sent at least twenty Value-Driven Networking™ outreach messages per day, five days per week, using the messaging and outreach process provided in the Program.
  • Used the Program resume, networking, messaging, follow-up, and job search methodology substantially as instructed.
  • Did not materially rewrite, replace, omit, or deviate from the provided messaging or strategy without prior approval from ElevateExecs.
  • Provided ElevateExecs with reasonable access to review or audit Participant's LinkedIn profile, activity records, application tracker, tailored resumes, messaging, and other documentation needed to verify compliance.

Participant must remain active and complete all required activities throughout the initial support period and any extension period. Failure to remain active may result in denial of the extension.

Participant must submit a written request for extended support, together with all required documentation, no later than seven calendar days after the original twelve-week support period ends.

Incomplete, inaccurate, altered, unverifiable, or misleading records may result in denial of the extension. ElevateExecs will evaluate eligibility reasonably and in good faith based on the documentation provided and Participant's material compliance with the Program methodology.

Support is limited to the initial twelve-week support period plus up to three additional months of support. No further support, extension, or refund is available beyond that period.

5. No Employment or Compensation Guarantee

ElevateExecs does not control hiring decisions, labor-market conditions, employer responses, interview invitations, background checks, compensation decisions, or job offers.

Except for the conditional extension of support described above, ElevateExecs does not guarantee that Participant will receive interviews, offers, employment, a particular title, a specific salary, or any other professional or financial result. The Qualifying Full-Time Offer standard defines when the Success Guarantee ends; it does not promise that Participant will receive or accept such an offer within a particular period.

Testimonials, examples, success rates, compensation outcomes, and prior client results are illustrative only and do not guarantee that Participant will achieve the same or similar outcome.

6. Intellectual Property and Personal-Use License

All Program content is owned by or licensed to ElevateExecs and is protected by intellectual-property law. This includes videos, recordings, modules, presentations, lessons, worksheets, workbooks, trackers, templates, prompts, scripts, outreach messages, follow-up sequences, coaching demonstrations, guides, downloads, participant examples, and all proprietary frameworks and methodologies, including The Superhero Job Search Method™, Superhero Personal Branding™, and Value-Driven Networking™.

Participant receives a limited, revocable, nonexclusive, nontransferable license to use the materials solely for Participant's own personal job search.

Participant may not:

  • Share Program materials or account access with a spouse, family member, friend, colleague, employer, recruiter, consultant, coach, client, or any other person.
  • Copy, reproduce, photograph, record, publish, upload, distribute, sell, sublicense, teach, or publicly display any Program content.
  • Post Program content, screenshots, recordings, templates, strategies, or messaging in social media groups, public forums, membership communities, websites, shared drives, or other online locations.
  • Upload substantial Program materials into an artificial-intelligence platform, content database, training system, or other third-party tool for publication, redistribution, replication, or development of competing materials.
  • Modify, repackage, reverse-engineer, or use the Program to create a competing course, coaching service, consulting service, training product, or derivative methodology.
  • Record any live coaching call or capture another participant's image, voice, comments, materials, or personal information.

Any unauthorized use or disclosure may result in immediate termination of access without a refund and may subject Participant to legal action.

7. Participant Confidentiality

The Program is intended to provide a confidential environment in which participants may discuss their careers, employers, compensation, interviews, challenges, personal circumstances, and job search activity.

Participant agrees not to disclose, discuss, publish, record, or distribute another participant's identity or participation in the Program; information shared during a coaching call or Program interaction; another participant's employer, job search, compensation, interviews, career concerns, documents, or personal circumstances; or screenshots, photographs, recordings, quotations, summaries, or identifying details from Program calls or communications.

Participant may not disclose another participant's information to family members, friends, colleagues, employers, recruiters, social-media contacts, online communities, or other third parties without that participant's express written permission.

These confidentiality obligations continue after Participant's Program participation ends. ElevateExecs will treat Participant information as confidential and will not intentionally disclose private information outside the Program except with permission, when reasonably necessary to provide the Program, or when required by law.

8. Group Call Recordings

Participant understands that group coaching calls may be recorded and made available to current Program participants. By joining a recorded call, Participant consents to the recording of Participant's name, image, voice, comments, questions, and contributions.

Participant may keep a camera turned off, use a first name only where the platform permits, or submit a question through another available method when greater privacy is desired.

Program recordings remain the property of ElevateExecs and may not be downloaded, copied, recorded, shared, or distributed by participants. ElevateExecs will not knowingly use a Participant's identifiable story as a public testimonial or marketing case study without permission.

9. Professional Conduct

Participants must communicate respectfully and professionally. Harassment, discrimination, threats, abusive conduct, deliberate disruption, solicitation of other participants, unauthorized promotion, or repeated interference with the experience of others is prohibited.

ElevateExecs may restrict participation, remove a Participant from a call or community, or terminate Program access for conduct that violates these Terms or materially affects another participant's privacy, safety, or experience.

10. No Refunds

Because the Program includes immediate access to proprietary digital materials and intellectual property, all enrollments are final and nonrefundable except where a refund is expressly required by applicable law.

Failure to attend live calls, access materials, complete assignments, participate in the Program, or use the available support does not create a right to a refund, credit, transfer, or extension.

11. Chargebacks and Payment Disputes

Participant agrees to contact ElevateExecs at madison@elevateexecs.us to resolve any billing concern before initiating a chargeback, payment dispute, or reversal with a bank, card issuer, or financing provider.

Initiating a chargeback or payment dispute without first contacting ElevateExecs, or in a manner inconsistent with the No Refunds provision above, is a breach of these Terms. In that event ElevateExecs may suspend or terminate Participant's access to the Program, and may pursue collection of amounts owed and reasonable costs of responding to the dispute, without limiting any other remedy available. A chargeback or payment dispute does not release Participant from the intellectual-property, confidentiality, or licensing obligations in these Terms.

12. Termination of Access

ElevateExecs may suspend or terminate Participant's access for unauthorized sharing or use of Program materials, violation of participant confidentiality, recording or distributing Program calls, harassment or disruption, misrepresentation or falsification of Guarantee records, initiating a chargeback in breach of these Terms, or any other material violation of these Terms.

Termination for a violation does not entitle Participant to a refund, credit, transfer, or Success Guarantee extension. Provisions concerning intellectual property, confidentiality, disclaimers, and liability survive termination.

13. Limitation of Liability

To the fullest extent permitted by law, ElevateExecs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost income, lost employment opportunities, reputational harm, or business losses arising from participation in or reliance on the Program.

To the fullest extent permitted by law, ElevateExecs' total liability arising from the Program will not exceed the amount Participant paid to enroll in the Program. Nothing in these Terms limits any liability that cannot legally be limited or excluded.

14. Changes to the Program

ElevateExecs may update course materials, coaching formats, instructors, technology platforms, call schedules, or Program processes when reasonably necessary. ElevateExecs may substitute substantially comparable support or content when a particular resource, call, platform, or instructor is unavailable.

Material changes will not reduce an active Participant's initial twelve-week support period or eliminate an earned Success Guarantee extension.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Before filing a legal claim, the parties agree to make a good-faith effort to resolve the matter through written communication and informal discussion.

16. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect, and the affected provision will be interpreted as closely as legally permitted to its original purpose.

These Terms, together with any enrollment page, written offer, privacy policy, or other terms expressly incorporated by reference, constitute the agreement governing Participant's enrollment and participation. Any waiver or amendment must be in writing.

17. Acknowledgment and Acceptance

By enrolling, electronically accepting these Terms, or accessing the Program, Participant confirms that Participant has read and understood these Terms; understands that the Program is group-based and does not include regularly scheduled one-on-one coaching calls; understands that active support lasts twelve weeks unless an extension is earned; understands that the Success Guarantee ends upon acceptance of a Qualifying Full-Time Offer or expiration of the maximum additional support period, not merely when an offer is extended; understands that interim or nonqualifying work does not end the Success Guarantee but does not excuse continued participation; understands that the Success Guarantee provides additional support only and not a refund; agrees to protect ElevateExecs' intellectual property; agrees to maintain participant confidentiality; and agrees to comply with the Program participation requirements.
